Personal Data Protection and Privacy Policy

§1 Glossary of terms

  1. SH NWAGNER – NWAGNER TECHNOLOGIES spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw, at the following address: ul. Trakt Lubelski 277D, 04-667 Warsaw, Poland, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw. Warsaw in Warsaw, 14th Commercial Division of the National Court Register, under KRS number: 0001108062, with NIP number: 9522256565, REGON number: 528743732, with a fully covered share capital of PLN 5,000.00.
  2. Customer – a natural person using the website available under the domain and its subdomains nwagner.pl or a natural/legal person using the services of SH NWAGNER.
  3. Newsletter – electronic messages sent via e-mail to a Potential Customer for marketing purposes.
  4. Potential Customer – a natural/legal person who expressed the desire to learn about SH NWAGNER’s offer.
  5. IP address – is a unique sequence of numbers assigned to devices in a computer network, enabling communication between them via the Internet Protocol (IP).
  6. MAC address – is a unique identifier assigned to network equipment (e.g. wireless card or Ethernet card) by the manufacturer. MAC stands for Media Access Control, and each identifier is unique to a specific device.
  7. Target Server – an isolated environment, created on a physical server using virtualization technology, leased by SH NWAGNER.
  8. Hosting – Technical maintenance.
  9. Service – IT system belonging to SH NWAGNER.

 

§2 Data processing

  1. The administrator of the personal data of the Customer and Potential Customer is SH NWAGNER (also called “administrator”).
  2. The Customer and Potential Customer may contact SH NWAGNER in matters related to their personal data via e-mail, by sending a message to the following address:biuro@nwagner.pl. The Customer and Potential Customer may also contact SH NWAGNER via traditional mail by sending a letter to the following address:

  1. The Administrator processes the following personal data of the Customer and Potential Customer:
    1. Name and surname and/or name,
    2. Phone number,
    3. E-mail adress,
    4. IP address,
    5. MAC address,
    6. Address for correspondence.
  2. The administrator uses data for the following purposes:
    1. Maintaining a newsletter,
    2. Handling inquiries via the form,
    3. Preparation, packing, shipping of goods,
    4. Implementation of ordered services,
    5. Debt collection,
    6. Presentation of an offer or information.
  3. The Administrator obtains data of the Customer and Potential Customer through:
    1. Saving cookies on the devices of the Customer and Potential Customer,
    2. Voluntary entry of data by the Customer and Potential Customer into IT systems belonging to the Administrator,
    3. Receiving business cards and willingness to contact from Customers and Potential Customers.

 

§3 Personal data protection methods

  1. The places of logging in and entering personal data are protected in the transmission layer (SSL certificate). Thanks to this, personal data and login data entered in SH NWAGNER’s IT systems are encrypted on the Customer’s/Potential Customer’s computer and can only be read on the target server.
  2. Personal data stored in the database are encrypted in such a way that only the Administrator who has the key can read them. Thanks to this, the data is protected in case the database is stolen from the server.
  3. SH NWAGNER IT systems use two-factor authentication, which is an additional form of protection for logging into SH NWAGNER IT systems.
  4. An important element of data protection is the regular updating of all software used by SH NWAGNER to process personal data, which in particular means regular updates of programming components.

 

§4 Hosting

  1. SH NWAGNER hosts its IT systems on the following servers:
    1. Your own,
    2. Operators:
      1. HOME.PL SA with its registered office in Szczecin at ul. Zbożowa 4, 70-653, REGON number: 811158242,
      2. ADMIN.NET.PL TOMASZ RZEPKA ARKADIUSZ NOWARA SC based in Tarnów, ul. Battles of Monte Cassino 5/198, 33-100,
  • Raidboxes GmbH with the registration number of the District Court in Münster: HRB 16184, with its registered office in Münster, at ul. Hafenstraße 32, 48153.
  1. Companies specified in §4 section 1 point aib, in order to ensure technical reliability, maintains logs at the server level. The following may be recorded:
    1. resources specified by the URL identifier (addresses of requested resources – pages, files),
    2. query arrival time,
    3. time of sending the response,
    4. name of the client station – identification carried out via the HTTP protocol,
    5. information about errors that occurred during the HTTP transaction,
    6. URL address of the page previously visited by the Customer/Potential Customer (referrer link) – if the transition to the SH NWAGNER IT system was made via a link,
    7. information about the user’s browser,
    8. IP address information,
    9. diagnostic information related to the process of self-ordering services via recorders on the website,
    10. information related to the handling of e-mails addressed to SH NWAGNER and sent by SH NWAGNER.

 

§5 Customer/Prospective Customer rights and additional information on how data is used

  1. In some situations, the Administrator has the right to transfer the personal data of the Customer/Potential Customer to other recipients if it is necessary to perform the contract concluded with the Customer/Potential Customer or to fulfill the obligations of SH NWAGNER. This applies to the following target groups:
    1. hosting company on an entrusted basis
    2. couriers
    3. law firms and debt collectors
    4. authorized employees and collaborators who use data to achieve the purpose of operation of SH NWAGNER IT systems,
    5. companies providing marketing services to SH NWAGNER
  2. The data of the Customer/Potential Customer/Potential Customer are processed by the Administrator no longer than is necessary to perform related activities specified in separate regulations (e.g. on accounting). With respect to data processed for marketing purposes, the data will not be processed for longer than 5 years.
  3. The Customer/Prospective Customer has the right to request from the Administrator:
    1. Access to your data.
    2. Rectification of your data.
    3. Deleting your data.
    4. Transferring your data.
  4. The Customer/Prospective Customer has the right to complain to the President of the Personal Data Protection Office.
  5. Providing personal data by the Customer/Potential Customer is voluntary, but necessary to establish cooperation with SH NWAGNER or use SH NWAGNER IT services.
  6. Activities involving automated decision-making, including profiling, may be undertaken in relation to the Customer/Potential Customer in order to provide services under the concluded contract and for the purpose of conducting direct marketing by SH NWAGNE.
  7. Personal data is not transferred from third countries within the meaning of personal data protection regulations. This means that we do not send them outside the European Union.

 

 

§6 Important marketing techniques

  1. SH NWAGNER uses statistical analysis of traffic on the Websites via Google Analytics (Google Inc. based in the USA). The operator does not transfer personal data to the operator of this service, only anonymized information. The service is based on the use of cookies on the Customer’s end device. In terms of information about the Customer’s preferences collected by the Google advertising network, the Customer may view and edit information resulting from cookies using the tool: https://www.google.com/ads/preferences/
  2. SH NWAGNER uses remarketing techniques that allow advertising messages to be tailored to the user’s behavior on the website, which may give the illusion that the Customer’s personal data are used to track him, but in practice, no personal data is transferred from SH NWAGNER to advertising operators. The technological condition for such activities is that cookies are enabled.
  3. SH NWAGNER uses a solution that automates the operation of the Website for Customers, e.g., which can send an e-mail to the Customer after visiting a specific subpage, provided that he or she has agreed to receive commercial correspondence from SH NWAGNER.

 

 

§7 Information about cookies

  1. The website uses cookies.
  2. Cookies (so-called “cookies”) are IT data, in particular text files, which are stored on the Customer’s end device and are intended for using the Websites. Cookies usually contain the name of the website they come from, their storage time on the end device and a unique number.
  3. The entity that places cookies on the Customer’s end device and obtains access to them is SH NWAGNER.
  4. Cookies are used for the following purposes:
    1. Maintaining the Customer’s session (after logging in), thanks to which the Customer does not have to re-enter the login and password on each subpage of the Website.
    2. Implementation of the goals specified above in §6.
  5. The Website uses two basic types of cookies: “session cookies” and “persistent cookies”. “Session” cookies are temporary files that are stored on the Customer’s end device until logging out, leaving the Website or turning off the software (web browser). “Permanent” cookies are stored on the Customer’s end device for the time specified in the cookie parameters or until they are deleted by the Customer.
  6. Software for browsing websites (web browser) usually allows cookies to be stored on the customer’s end device by default. Customers can change the settings in this regard. The web browser allows you to delete cookies. It is also possible to automatically block cookies. Detailed information on this subject can be found in the help or documentation of your web browser.
  7. Restrictions on the use of cookies may affect some of the functionalities available on the Websites.
  8. Cookies placed on the Website Customer’s end device may also be used by entities cooperating with SH NWAGNER, in particular the following companies: Google (Google Inc. based in the USA), Facebook (Facebook Inc. based in the USA), Twitter (Twitter Inc. based in the USA).

 

§8 Cookies

If the Customer does not want to receive cookies, he or she can change the browser settings. We reserve that disabling cookies necessary for authentication processes, security, and maintaining user preferences may make it difficult, and in extreme cases, impossible to use SH NWAGNER IT systems.

 

§9 Protection of personal data stored in physical form

  1. The Administrator has the right to store the personal data of the Customer/Potential Customer in paper form.
  2. Only a person authorized in writing by the owner of SH NWAGNER – Norberta Wagner – has access to the personal data of the Customer/Potential Customer saved in paper form.
  3. The Administrator disposes of the Customer’s/Potential Customer’s personal data saved in paper form in the event of:
    1. Expression of the will of the Customer/Potential Customer, in accordance with §5 section 3. pts. 3.,
    2. Such a decision is made by the Administrator.
  4. In the case of the situation specified in §9 section 3. The Administrator gets rid of the personal data of the Customer/Potential Customer by using a paper shredder or using document destruction services.

 

§10 Final provisions

  1. SH NWAGNER reserves the right to change the Policy.
